Go Truck 360 is a duly established and legally recognized logistics service provider based in [State], USA. These Terms of Service (“Terms”) govern your use of our website located at https://gotruck360.example.com (together, the “Service”) operated by Go Truck 360. Our Privacy Policy, which explains how we collect and safeguard your information, is incorporated by reference.
2. Terminologies
In these Terms, the following definitions apply:
Go Truck 360 (“Company”): Refers to Go Truck 360, its affiliated entities, and subsidiaries, operating as a logistics service provider.
Service Provider: A third-party logistics partner or freight service provider, licensed or authorized as required by applicable regulations, who performs transportation, dispatch, or digital logistics support.
Customer: Any individual, company, or entity (including their agents or representatives) that engages our Service for freight dispatching, load coordination, or digital logistics solutions.
Order: The Customer’s request for Go Truck 360 to arrange logistics services.
Order Confirmation: A written or electronic confirmation provided by Go Truck 360 to the Customer detailing the agreed services, scheduled dates, and associated fees.
Logistics Services: Services provided by Go Truck 360 that include freight dispatching, load coordination, digital logistics solutions (e.g., GPS tracking, route analytics, and fleet management software), back-office support (e.g., billing, invoicing, and compliance assistance), and related advisory services.
3. Our Services
Go Truck 360 provides a suite of logistics services designed to simplify operations for truckers, fleet owners, and shippers, including:
Freight Dispatching & Load Coordination:
We connect owner-operators and small fleets with high-paying loads, handle load bookings, negotiate rates, and manage necessary documentation.
Digital Logistics & Fleet Management:
We leverage advanced technology to offer real-time tracking, route optimization, e-log/ELD compliance support, and data-driven insights to keep your operations running efficiently.
Back-Office Support & Compliance Assistance:
We offer assistance with billing, invoicing, carrier–customer agreements, and even support services such as FMCSA & DOT compliance and IFTA & permits filing, without the need for you to maintain direct carrier authority.
4. Customer’s Obligations
When using our Service, you agree to:
Provide accurate and complete information regarding your logistics needs, including any relevant details about loads, routes, or specific requirements.
Cooperate with our Service Providers by following any pre-arranged instructions regarding pick-up, documentation, and delivery coordination.
Review the Order Confirmation carefully; any modifications requested after confirmation may incur additional fees.
Ensure that any documentation or special instructions provided are accurate, as discrepancies may lead to delays or additional charges.
5. Payment Policy and Procedures
Payment Responsibility:
Payment for our services is due according to the terms specified in the Order Confirmation. All fees for services rendered are non-refundable once a Service Provider has been assigned, except as otherwise stated in these Terms.
Reservation Fee:
To confirm an Order, a fixed reservation fee is charged. This fee is refundable only if the Order is canceled before a Service Provider is assigned. Once a Service Provider is engaged, the fee becomes non-refundable.
Method of Payment:
Payments may be made via approved electronic methods. All outstanding invoices may accrue interest at a rate of 1.5% per month, and the Customer is responsible for any collection expenses incurred by the Company.
6. Cancellation and Reimbursement
Cancellations must be submitted via email to [sales@gotruck360.net]. Cancellation fees vary based on the stage of service:
Before Service Provider Assignment: Full refund of the reservation fee.
After Assignment but Prior to Dispatch: A partial refund may be provided as specified in the Order Confirmation.
After Dispatch or During Execution: Cancellations are not permitted, and the full fee is due.
7. Limitation of Liability
While we take every precaution to ensure that your logistics needs are met efficiently, our total liability for any claims or damages arising from these Terms will not exceed the total fees paid by the Customer for the relevant service. Under no circumstances will Go Truck 360 be liable for any indirect, incidental, consequential, or punitive damages.
8. Dispute Resolution
Any disputes arising from or related to these Terms or our Services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. By using our Service, you agree to waive your right to a trial by jury.
9. Amendments and Miscellaneous
Governing Law: These Terms are governed by the laws of the United States and the State of [State], without regard to conflict of law principles.
Changes to Service or Terms: We reserve the right to amend our Service and these Terms at any time. Continued use of the Service constitutes acceptance of any changes.
